1. Acceptance of Terms

By accessing, downloading, installing, or using the Calabi mobile application ("Calabi", "the App") or the website https://calabi.fit, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Health & Fitness Disclaimer.

Calabi is operated by Youssef El Fajlaoui as an individual software developer based in Valencia, Spain("Calabi", "we", "us", or "our").

2. Beta Testing Program & Service Evolution

Calabi is currently distributed in an active Beta Testing Phase on Google Play. During this beta period, core features (including AI coaching chat, vision meal scanning, workout tracking, and epistemic memory engine) are made available free of charge to registered and invited testers for testing, feedback, and product evaluation.

Features in beta may be updated or temporarily adjusted during ongoing development. We reserve the right to introduce commercial subscription tiers upon general availability on the Google Play Store.

3. Eligibility & Age Limit

You must be at least 16 years old to create an account or use Calabi. Calabi is designed for individuals capable of safely undertaking physical exercise and managing their nutrition.

4. Nature of Service & Health Disclaimer

Calabi is an AI personal fitness companion and is not a medical device, clinical diagnostic tool, or healthcare provider. All calorie targets, macronutrient calculations, workout routines, and coaching advice are algorithmic estimates and general suggestions.

Mandatory Physician Consultation: Always consult with a licensed doctor or healthcare professional before beginning any new exercise routine, diet, or caloric deficit. You agree to read and comply with our Health & Fitness Disclaimer.

5. User Accounts & Deletion

You are responsible for maintaining the confidentiality of your login credentials. You can delete your account and all associated data at any time directly in the app or via our Web Deletion Page.

6. In-App Subscriptions & Billing (Google Play)

When commercial paid subscription tiers are active:

• Billing: All payments and subscription management are handled securely through Google Play In-App Billing.
• Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours prior to the renewal date via Google Play account settings.
• EU Consumer Rights: Under Directive 2011/83/EU and Spanish consumer law (LGDCU), consumers benefit from statutory withdrawal rights. Where digital services commence immediately with the user's prior express consent and acknowledgment during checkout, the statutory right of withdrawal may cease upon performance commencement. Users may cancel future renewals at any time via Google Play.
• Refunds: Refund requests are governed by Google Play's standard policies and must be submitted through the Google Play Store.

7. Intellectual Property & User Content

You retain ownership of your workout logs, photos, and messages. You grant Calabi a non-exclusive license to process this content solely to operate the AI coaching service. All Calabi code, designs, algorithms, and branding are the intellectual property of Youssef El Fajlaoui.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of Spain and applicable EU consumer regulations. Any disputes shall be subject to the jurisdiction of the courts of Valencia, Spain, without prejudice to mandatory consumer protections in your country of residence.
